Iremos divulgando as informação que seja relevante, porquanto por vezes as respostas recebidas não são verdadeiramente esclarecedoras relativamente ao entendimento adoptado.<br>
<br>
<strong>1. Respostas APA</strong><br>
<br>
Parte das questões colocadas já foi respondida, mas de forma incompleta, pelo que foram pedidos esclarecimentos adicionais. As respostas centram-se mais em aspectos decorrentes do Unilex, e não, como era questionado, em análises à face do PPWR. Partilhamos apenas parte da resposta a uma empresa associada (empresa X) que no fundo presta serviços de intermediação na aquisição de embalagens e procede ao seu enchimento e envio aos consumidores e/ou utilizadores finais, por conta do seu cliente (empresa Y):</span><br>

<span style="color:#0000CD"><em>"Note-se que as embalagens de expedição, como caixas dobráveis, material de enchimento ou envelopes, podem tornar-se embalagens quando são utilizadas pelo distribuidor para expedir mercadorias. Embora inicialmente não sejam consideradas embalagens de venda, elas adquirem essa função ao serem utilizadas para proteger e transportar produtos até o consumidor final.<br>
Tais embalagens enquadram-se na definição de embalagem de serviço, definida no UNILEX como a embalagem que se destine a enchimento num ponto de venda para acondicionamento ou transporte de produtos para ou pelo consumidor.<br>
No caso específico das embalagens de serviço não reutilizáveis o responsável pelo cumprimento das obrigações legais dispostas no UNILEX, incluindo as obrigações de registo, é:<br>
- O fornecedor das embalagens de serviço, ou seja, é o fabricante das embalagens de serviço, no caso das embalagens serem fabricadas em território nacional e colocadas no mercado nacional, ou<br>
- O adquirente ou importador das embalagens de serviço no caso de adquirir as mesmas noutro país da UE ou num país terceiro, respetivamente, e as colocar no mercado nacional, ou<br>
- A empresa localizada noutro país da União Europeia ou num país terceiro e que venda diretamente a utilizador final localizado em Portugal a embalagem de serviço, tendo para tal que nomear um representante autorizado em Portugal."<br>
<br>
"Nos termos previstos no Regulamento (UE) 2025/40, a empresa X passará a ser o prestador de serviços de execução, papel que eventualmente acumulará com o de produtor (distribuidor ou importador) na situação de estar a adquirir/importar as embalagens de outro país antes de colocar no mercado em Portugal (vender à empresa Y).<br>
Considerando que as responsabilidades pelas embalagens de comércio eletrónico já são satisfeitas por outras entidades, a empresa Y apenas assumirá o papel de produtor (fabricante) na aceção do Regulamento (UE) 2025/40 na situação dos artigos se encontrarem previamente embalados numa embalagem de venda distinta da embalagem de comércio eletrónico."</em></span></span></span></p>

A Intergraf, confederação europeia de que a APIGRAF é membro, partilhou recentemente alguma informação que se destina apenas a manter as empresas a par da evolução que se vai verificando. No entanto, sublinha-se que até informação em contrário a empresa deve preparar-se para o cumprimento da legislação em vigor. Da informação recebida da Intergraf referem-se apenas os seguintes pontos:</span><br>
<span style="color: #000000;"><span style="color:#000000">- está disponível uma nova versão do documento <a href="https://us.list-manage.com/cg8ST_shaOv?e=2ef8735660&c2id=187e001b61c231074e726e0e9d51e8ff" target="_blank" style="mso-line-height-rule: exactly;-ms-text-size-adjust: 100%;-webkit-text-size-adjust: 100%;color: #C52E26;font-weight: bold;text-decoration: none;">"Guidance", já com a versão em português</a>; neste esclarece-se </span></span><font color="#000000">(pág. 23) que "</font><em><span style="color:#0000CD">Deve entender-se que, até à data de aplicação do artigo 6.º, n.º 2, alínea a), do RERE relativo aos critérios de conceção para a reciclagem </span></em><span style="color:#000000">(Nota APIGRAF: 1jan2030)</span><em><span style="color:#0000CD">, os fabricantes têm de cumprir apenas os requisitos em conformidade com a Diretiva Embalagens e Resíduos de Embalagens e com as respetivas normas harmonizadas [por exemplo, EN 13430:2004 \u2014 Requisitos para embalagens valorizáveis por reciclagem do material".</span></em><br>
<span style="color: #000000;">- prevê-se nova comunicação da Comissão sobre PFAS, eventualmente ainda em junho: ciente de que a realização sistemática de testes para deteção de PFAS em materiais destinados ao contacto com alimentos não é exequível na prática, a ideia será aceitar uma abordagem baseada no risco, que passa por evidenciar que os PFAS não foram adicionados intencionalmente e qual o risco de contaminação. Sublinhamos que enquanto esta publicação não se faça este ponto não deve ser tido em consideração.<br>

<span style="color:#000080"><em>"Estamos a receber muitas questões por parte dos fabricantes de embalagens relativamente aos novos <strong>requisitos em matéria de conformidade PFAS </strong>no âmbito do Regulamento relativo a Embalagens e Resíduos de Embalagens (PPWR/RERE).</em></span></span></span></p>

Não existe atualmente uma metodologia harmonizada para avaliar a conformidade com os limites de PFAS; a ECMA recomenda às empresas a criação de um <strong>inventário de materiais PFAS para cada embalagem destinada ao contacto com alimentos</strong>, <strong>solicitando a quem lhe fornece as diversas matérias</strong>:<br>
a) <u><strong>Informação sobre quaisquer substâncias restritas utilizadas</strong></u><br>
b) <u><strong>Declarações de não utilização de PFAS</strong></u><br>
c) <u><strong>Declarações REACH relativas a SVHC</strong></u> ("Substances of Very High Concern" ou Substâncias que Suscitam Elevada Preocupação)<br>

e) <u><strong>Relatórios recentes de ensaios analíticos</strong></u> (se disponíveis)</em></span></span></span>

É muito importante que o <u><strong>stock </strong></u>de produto acabado que a sua empresa ou os seus clientes tenham em armazém, e <strong><u>relativamente ao qual não exista confirmação de conformidade PFAS,</u></strong> seja <strong><u>\u201ccolocado no mercado\u201d antes de 12 de agosto de 2026</u></strong>. Uma vez que a maioria das embalagens são comercializadas como<strong> embalagens de venda e embalagens grupadas</strong>, é o embalador ("enchedor") que coloca a embalagem no mercado, e nesta situação a sua empresa deverá <strong>falar com o seu cliente para assegurar</strong> que o pproduto que lhes fornece é "cheio" e <strong>colocado no mercado antes de 12 de agosto de 2026</strong>. Caso a sua empresa fabrique <strong>embalagens de transporte ou de serviço</strong>, é a sua empresa que procede à colocação no mercado, pelo que qualquer<strong> stock potencialmente não conforme deverá ser vendido antes de 12 de agosto de 2026</strong>."</em></span></span></span>
